Terms of Service
Kyrve
Last updated: [DATE] Effective: [DATE]
1. Who we are
Kyrve is operated by [COMPANY NAME] Ltd, a company registered in England and Wales (company number [NUMBER]), registered office [ADDRESS].
In these terms, "we", "us" and "our" mean [COMPANY NAME] Ltd. "You" and "your" mean the person using Kyrve.
You can reach us at [SUPPORT EMAIL].
2. What Kyrve does
Kyrve is a tool. You pick a template, upload one or more photographs, and we pass those images and a set of instructions to third-party artificial intelligence models, which generate video. We return the result to you.
We do not create your content and we do not review it before you receive it. The models decide what the output looks like. We write the templates and choose the models; we cannot guarantee any particular result.
3. You must be 18 or over
You may only use Kyrve if you are 18 or over. By using Kyrve you confirm that you are.
We do not knowingly allow anyone under 18 to hold an account. If we believe an account holder is under 18 we will close the account and refund any unused credits.
4. Your account
You are responsible for your account, for keeping your login secure, and for everything that happens under it. Tell us immediately at [SUPPORT EMAIL] if you think someone else has access.
One person, one account. You may not share an account unless you are on a plan that explicitly includes multiple seats.
5. Photographs you upload
This section is the most important part of these terms. Please read it.
5.1 You must have the right to upload the image
By uploading a photograph you confirm that:
- you own it, or you have permission from whoever does; and
- every identifiable person in it has given you permission for it to be used to generate the kind of video the template produces; and
- no person in it is under 18.
5.2 Other people's faces
If you upload a photograph of someone other than yourself, you are responsible for having that person's permission. We will ask you to confirm this. We rely on that confirmation.
If someone tells us their image has been used without their permission, we will remove the content and may suspend or close your account. See section 11.
5.3 What you must not generate
You must not use Kyrve to create anything that:
- is sexual, intimate or nude, or sexualises any person;
- depicts anyone under 18 in any context;
- depicts real violence, abuse, self-harm, or cruelty;
- is intended to harass, bully, defame, intimidate or humiliate anyone;
- impersonates a real person in a way intended to deceive — including putting words in their mouth, or presenting generated video as genuine footage;
- depicts a real person committing a crime, or saying something that could damage their reputation;
- promotes hatred or violence against any group;
- infringes anyone's intellectual property, including trade marks, logos, kits, badges and broadcast footage;
- is unlawful in the United Kingdom, or in any country where you publish it.
This list is not exhaustive. If something would obviously cause harm, do not make it.
5.4 We screen uploads and outputs
We run automated checks on images you upload and on videos we generate. Some requests will be refused. We do not always explain why, and the decision is ours. A refusal is not a judgement about you; the checks are deliberately cautious.
Third-party model providers also apply their own checks and may refuse a request. Where that happens we release any credits we reserved for the work they did not do.
6. Credits, plans and payment
6.1 How credits work
Generations are paid for with credits. A subscription includes a monthly credit allowance. You can also buy one-off credit top-ups.
The credit cost of a generation is shown before you confirm it.
6.2 You pay per attempt, not per result
Credits are consumed each time a generation runs, whether or not you like the result. Generating again — a "reroll" — is a new generation and costs credits again.
This is because we are charged by our model providers for every generation, successful or not.
6.3 When we do not charge you
We will not charge you, or we will return credits already reserved, where:
- a generation fails because of a technical fault on our side or a provider's;
- a generation is refused by a provider's content checks;
- a template is found to be defective and we withdraw it.
We decide these cases in good faith. If you think a charge is wrong, contact [SUPPORT EMAIL].
6.4 Expiry and roll-over
Monthly subscription credits [DO NOT ROLL OVER / ROLL OVER WHILE YOUR SUBSCRIPTION IS ACTIVE — CHOOSE AND BE CONSISTENT WITH THE PRICING PAGE].
Purchased top-up credits expire [PERIOD] after purchase.
Unused credits have no cash value and cannot be exchanged for money, except where the law requires it.
6.5 Subscriptions
Subscriptions renew automatically until you cancel. You can cancel at any time from your account. Cancellation takes effect at the end of the current billing period; you keep access until then.
Prices may change. We will give you at least 30 days' notice before a change affects you, and you may cancel before it takes effect.
6.6 Payment processing
Payments are taken by [PADDLE / LEMON SQUEEZY / STRIPE], who act as [merchant of record / payment processor]. We do not store your card details.
6.7 Your cancellation rights
If you are a consumer in the UK or EU you normally have 14 days to cancel a purchase of digital content.
By starting a generation, you ask us to begin supplying digital content immediately and acknowledge that you lose the right to cancel for content already supplied. Credits you have not yet used remain refundable within the cancellation period.
Nothing in these terms affects your statutory rights.
7. What you own, and what we can do with it
7.1 Your content
You keep whatever rights you have in the photographs you upload and the videos Kyrve generates for you. We do not claim ownership.
You may use your generated videos commercially, subject to these terms and to you actually having the rights described in section 5.
Be aware that the legal position on who owns AI-generated output is unsettled in the UK and elsewhere. We cannot promise that you own copyright in a generated video, or that it can be registered or enforced.
7.2 Licence to us
So that we can run the service, you give us a licence to store, copy, process and transmit your uploads and outputs — including sending them to third-party model providers. This licence lasts as long as we hold the content and ends when we delete it.
7.3 Showing your work
We will not publish your content without asking. If you opt in — through a setting in your account, or by submitting something to us for that purpose — you give us a non-exclusive, worldwide, royalty-free licence to display that content on our website, in our apps and in our marketing, with or without attribution as you choose.
You can withdraw this at any time by contacting us. We will stop using it in new material, though we cannot always recall material already published.
7.4 Our content
The Kyrve name, logo, website, software, templates and prompts are ours. You may not copy, resell, reverse-engineer or redistribute them, or use automated means to extract template definitions or prompt text.
8. Availability
We try to keep Kyrve running but we do not promise it will always be available or error-free. We may change, suspend or withdraw any part of it, including individual templates and models, without notice.
Generation times vary and depend on third parties. We do not promise any particular speed.
Generated media is stored for [PERIOD]. Download anything you want to keep.
9. Third-party models
Kyrve works by sending your content to third-party providers. These currently include providers operating in the United States and China, and the list changes as models change. See our Privacy Policy for more detail.
Those providers have their own terms and content rules. We are not responsible for their decisions, their availability, or how they handle requests, though we choose them carefully and tell you where your data goes.
10. Acceptable use
In addition to section 5, you must not:
- use Kyrve for anything unlawful;
- attempt to circumvent our content checks, credit system or rate limits;
- use automated means to access Kyrve except as we expressly allow;
- resell access to Kyrve, or use it to operate a competing service;
- attempt to access other users' content or accounts;
- interfere with the service or place unreasonable load on it;
- use stolen or unauthorised payment methods.
11. Reports, suspension and termination
11.1 Reporting content
If you believe content made with Kyrve infringes your rights, uses your image without permission, or breaks these terms, report it to [ABUSE EMAIL] or through the reporting link on our site. Tell us what the content is, why it is a problem, and how to reach you.
We will act on reports of intimate imagery or content involving a minor immediately, and on other reports within [TIMEFRAME].
11.2 Suspension
We may suspend or close your account, remove content, and withhold or cancel credits, if we reasonably believe you have broken these terms — particularly sections 5 and 10.
Where we can, we will tell you why and give you a way to respond. Where the breach is serious, or the law requires it, we may act first.
11.3 Your right to leave
You can close your account at any time. Unused subscription credits are not refunded on closure unless the law requires it; unused top-up credits purchased within the last [PERIOD] will be refunded on request.
12. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Your statutory rights as a consumer are unaffected.
Subject to that:
- We are not liable for how you use generated content, or for any consequence of publishing it.
- We are not liable for loss of profit, business, goodwill, data or opportunity, or for any indirect or consequential loss.
- Our total liability to you in any 12-month period is limited to the greater of £100 or the amount you paid us in that period.
If you are using Kyrve for business purposes, you agree that Kyrve is provided "as is" and we exclude all implied warranties to the extent the law allows.
13. You indemnify us
If you are using Kyrve for business purposes: you will cover our losses, including reasonable legal costs, arising from a claim brought against us because of content you uploaded or generated, or because you broke these terms.
This does not apply to consumers.
14. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you by email or in the app at least [14/30] days before it takes effect. If you do not accept it, you may cancel.
15. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory laws of where you live, and may bring proceedings there.
If something goes wrong, please contact us first at [SUPPORT EMAIL]. We would rather fix it than argue about it.
16. General
- If any part of these terms is unenforceable, the rest still applies.
- Our not enforcing something does not waive our right to enforce it later.
- You may not transfer your rights under these terms. We may transfer ours if we sell or restructure the business, and will tell you if we do.
- These terms, our Privacy Policy and our Acceptable Use Policy are the whole agreement between us.
